(1) Learned counsel appearing for the petitioner would submit that petitioner is an elected Sarpanch of Gram Panchayat Basantpur. He was removed from the said post by the Sub Divisional Officer (Revenue) vide order dated 16.02.2018, against which, he preferred appeal before the Collector, which is pending consideration, and in which interim order was also granted on 4.4.2018, though it has not been extended. In the meanwhile, election to the post of Gram Panchayat - Basantpur has been notified by the Collector, Balrampur and if the election is allowed to be held, proceeding pending before the Collector would become infructuous and, therefore, directions may be issued to the respondent No. 2 - Collector, Balrampur - Ramanujganj to consider and decide the appeal of the petitioner expeditiously.

(2) Be that as it may, respondent No. 2 - Collector, Balrampur - Ramanujganj is directed to consider and dispose of the petitioner's appeal expeditiously preferably within a period of four weeks from the date of receipt of certified copy of this order. (3) For the period of four weeks, interim order granted earlier shall remain in operation.
