Order On Board By Hon'ble Justice Shri Prashant Kumar Mishra 18/06/2019

1. The issue brought before this Court concerns election of the Chhattisgarh Pradesh Archery Association. The said Association is a society registered under the Chhattisgarh Society Registrikaran Adhiniyam, 1973 (in short 'Adhiniyam, 1973'). Petitioner has filed copy of the by laws of the Society in which Clause 27 speaks about the resolution of disputes. The said clause provides that in the case of dispute of any nature arising in the society the same shall be resolved by the General Body and if parties are not satisfied then the matter may be raised before the Registrar.

2. In view of the internal mechanism for resolution of dispute in the society the writ petition is not maintainable which is otherwise brought in relation to election of society which is neither a statutory body nor the issue of election is any statutory activity.

3. Let the petitioner raise a dispute before the Registrar under the Adhiniyam, 1973, within a period of 4 weeks from today. On said dispute being raised the Registrar shall decide the same in accordance with the law after hearing all the parties concerned within a reasonable period.

4. The writ petition is disposed of in the manner indicated above.
