WPPIL No.96 of 2021 12-8-2021
1. Heard.
2. In this petition in the nature of PIL, the petitioner has prayed for a direction to the respondent Revenue Authorities for deciding the application for mutation of name in the revenue record, expeditiously.
3. It is submitted that after purchase of the property or on account of any other eventuality, whenever application for mutation of name is moved on behalf of the effected persons, the same is kept pending on one pretext or the other.
4. We are afraid that a PIL of this nature cannot be entertained for issuing a general omnibus direction to Revenue Authorities who are required to decide matters depending upon the facts of each case.
5. A general direction cannot be issued to decide all pending mutation applications within a particular time period. Having said so, we hope that the Revenue Authorities shall proceed to decide pending mutation application in accordance with law and the same shall not be kept pending unnecessarily.
6. Accordingly, the present WPPIL is dismissed, subject however to the observations made above.
