(2) Learned counsel appearing for the State/respondents submits that the order of termination of the petitioner is appealable before the Divisional Commissioner (Revenue). (3) Learned counsel appearing for the petitioner submits that he may be permitted to withdraw this instant petition with liberty to prefer an appeal before the Divisional Commissioner (Revenue).
(4) Prayer appears to be fair and reasonable.
(5) Accordingly, the petitioner is permitted to file an appeal before the Divisional Commissioner (Revenue). If such appeal is filed by the petitioner before the Divisional Commissioner (Revenue) within a period of 30 days from today, the concerned authority shall consider and decide the same on its own merit and in accordance with law preferably within a period of three months from the date of receipt of copy of this order. (6) With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).
