Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 12/07/2016 Petitioner and respondent No.4 submitted their applications for appointment as the agency to supply Ready to Eat food material for Kuli sector, Child Development Project, Seepat. In the selection process, the petitioner - self-help group was found ineligible and respondent No.4 - self-help group has been awarded the work vide impugned order dated 09.11.2015.

Learned counsel for the State would submit that one of the members of the petitioner - self-help group is working as Aanganbadi worker, therefore, in terms of clause

(2) of the guideline dated 03.12.2014 providing the procedure for selection of self-help groups for supply of Ready to Eat food material, the petitioner has been declared

ineligible.

Neither in the writ petition nor by way of rejoinder, the petitioner has controverted the said fact that one of its members is working as Aanganbadi worker. If that be so, the respondents' decision to declare the petitioner - self-help group as ineligible does not suffer from any infirmity. Similarly, the selection of respondent No.4 - self-help group also does not appear to be illegal or arbitrary because nothing has been pointed out as to why respondent No.4 - self-help group would be ineligible or incompetent in the field of supply of Ready to Eat food material.
