1. The applicant has preferred this first bail application under Section 439 of Cr.P.C. as he is in jail since 08.07.2021 in connection with Crime No. 131/2021 registered in Police Station- Fingeshwar, District Gariaband (CG) for the offence punishable under Sections 376, 509 (B) & 506 of IPC; Section 3(2) (v) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 and Section 67A of Information Technology Act, 2000.

2. Learned counsel for the applicant seeks to withdraw the present bail application with liberty to file appropriate appeal under Section 14 (A) (2) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989.

3. Accordingly, the bail application is dismissed as withdrawn with the liberty as stated above.
