1. Heard.

2. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.195/2020 registered in Police Station Police Pipariya, Civil and Revenue District Kabirdham C.G. for the offence punishable under Section

MCRC No. 5818 of 2020 307, 294 of the I.P.C.

3. Case of the prosecution, in brief, is that on a dispute concerning return of the loan amount, the applicant caused injuries over the person of the victim by means of hoe (kudali) causing injuries over the head.

4. The victim was discharged from the hospital after three days and has not sustained any bony injury.

5. Learned State counsel would oppose the prayer for grant of bail.

6. Considering that the applicant is in jail since 08.07.2020 i.e., for more than three months and the charge sheet has already been filed, this Court is inclined to release the applicant on bail.

7. Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of ₹50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
