2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.120/2020 registered at Police Station Police Chowki Baldei, Surajpur, District Surajpur (CG) for the offence punishable under Sections 363, 366, 376(3) of the IPC and Sections 4, 6 of the Protection of Children From Sexual Offences Act, 2012.

3. The applicant abducted and committed rape with the prosecutrix, aged less than 13 years, on promise to marry.

4. Considering the age of the prosecutrix, the present is not a fit case to release the applicant on regular bail at this stage.

5. Accordingly, the bail application is dismissed reserving liberty to the applicant to move again after examination of the prosecutrix.
