For Non-Applicant : Shri Gagan Tiwari, Deputy GA. Proceeding Through Video Conferencing Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 27/10/2020 :

1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.258/2020 registered in Police Station Telibandha, Raipur District Raipur for offence under Section 363 & 365/34 of the IPC.

2. Applicant along with co-accused Monu Prajapati abducted the victim aged about 8 years with an intent to sell the victim elsewhere. The applicant and co-accused were caught by the members of the locality on the place of occurrence itself.

3. Learned counsel for the applicant would submit that presently the

applicant has been released on parole and the offences are triable by the JMFC and charge sheet has already been filed.

4. Learned State Counsel would oppse the prayer for grant of bail.

5. Considering that the allegation is about attempt to kidnap the victim and the offences are triable by the JMFC, as also for the reason that charge sheet has already been filed, I am inclined to release the applicant on bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
