Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 18/06/2019

1. Petitioner owns land at village Lormi, Tahsil Lormi, District Mungeli. His grievance raised in the Writ Petition is to the effect that the owners of the adjoining land have manipulated the land records in collusion with the Patwari and other revenue officers with an eye to grab and encroach

WPC No. 1990 of 2019 petitioner's land.

2. It appears the matter raised in the Writ Petition would require an inquiry preceded by a demarcation, therefore instead of keeping this Writ Petition pending it is disposed of with observation that the petitioner may approach before the concerned Tahsildar for correction of land records and demarcation of land belonging to the petitioner and other adjoining land owners. On such application being moved by the petitioner, the concerned Tahsildar/Nayab Tahsildar shall proceed in accordance with law as provided under the C.G. Land Revenue Code, 1959.

3. In the case, any dispute concerning title over the land is found to have arisen during the proceedings before the Tahsildar/ Nayab Tahsildar, petitioner would be at liberty to prefer duly constituted civil suit before the jurisdictional Civil Court.
