The applicant has preferred this first bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.363/2018, registered at Police Station Kotwali, District Raigarh, for the offence punishable under Sections 3, 4, 5 of the Illicit Trafficking Prevention Act, 1956.

It is submitted that the applicant has been falsely implicated in the present case. He is in jail since 10.04.2018. The charge sheet has been filed after completion of the investigation. One of the co-accused namely Ishwar Mandavi has been granted bail by the Coordinate Bench of this Hon'ble Court in MCRC No.3274/2018 on 25.06.2018. Therefore, the applicant may be released on bail.

On the other hand, learned State counsel opposes the bail application.

According to the prosecution case, the applicant is an owner of the house and used to provide accommodation for the illegal business of prostitution. This was disclosed in a testing raid conducted by the Police Personnels of Police Station City Kotwali, District Raigarh.

After considering all the materials present in the case diary and looking to the time that is required for the conclusion of the trial, I am of this view that it is a fit case for grant of bail to the applicant. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court.
