1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested in connection with Crime No. 315/2020 for the offence punishable under Section 307 of IPC, registered at Police Station- Mandir Hasaud, District- Raipur (C.G.).

2) After arguing for sometime, learned counsel appearing for the applicant seeks to withdraw this application with liberty to repeat his prayer for bail by filing a fresh application, if the trial is not concluded within a period of six months from today.

3) Counsel for the State has no objection to the above prayer.

4) Permission granted.

5) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
