The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.220/2020 registered in Police Station Utai, District Durg (C.G.) for offence punishable under sections 420 and 34 of I.P.C.

As per the prosecution case, a complaint was made by Punit Ram that he entered into agreement for purchase of property and subsequently sale deed was executed wherein sale consideration though 66 lakhs was assured by Kamalnath to be paid but the cheque was not honoured. It is allegation that the present applicant was instrumental to allure the complainant to execute sale deed on the pretext that finance would be advanced so that sale consideration is paid.

Learned counsel for the applicant submits that charge sheet has been filed, the applicant is not the beneficiary, no fraud has been committed, applicant is in jail since 02/08/2020, therefore the applicant

may be released on bail.

Learned State counsel opposed the prayer for grant of bail. 5.

Considering the nature of allegation and the fact that charge sheet has been filed and all the evidence has been collected, applicant is in jail since 02/08/2020, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
