Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 24/11/2015 Heard.
1. At the time when this contempt petition was filed, the petitioner had alleged that the petitioner is not being allowed to work nor he is being paid salary.
2. Today, learned counsel for the parties submit that though the petitioner has been allowed to work and is presently working, salary for the months of August & September, 2015 has not been paid.
3. Taking into consideration that there existed a dispute between the parties with regard to the date of joining and that there are allegations and counter allegations, at the time of hearing of the writ petition, the petitioner may submit
necessary documents and affidavit and pray for direction for payment of salary of the intervening period for which he claims non-payment.
4. The contempt petition is accordingly finally disposed off. Rule is discharged.
5. It is made clear that the order passed by the Court clearly implies not only joining but payment of salary also to the petitioner and, therefore, at least from the undisputed date of joining of the petitioner, the petitioner would be paid salary.
