The applicant has preferred this first bail application under Section 439 of CrPC for grant of regular bail, as he is arrested in connection with Crime No.95/2018, registered at Police Station Sakari, District Bilaspur (C.G.), for the offence punishable under Sections 457, 380, 411, 34 of IPC.

It is submitted that the applicant has been falsely implicated in the present case and he is in jail since 03.04.2018. The charge sheet has been filed after completion of the investigation. The applicant does not have any previous criminal antecedents. Therefore, the applicant may be released on bail.

On the other hand, learned State counsel opposes the bail application.

Heard learned counsel for the parties and perused the case diary. 5.

The prosecution case in brief is that the complainant Akshay Tiwari has lodged an FIR stating that the theft was committed in his house in his absence, in which cash and other articles worth Rs.357,400 were stolen and at the instance of the applicant, some of the articles were recovered.

After considering all the materials present in the case diary and also taking into consideration the fact that the applicant has no criminal antecedents and he is a local resident of District Bilaspur, I am of this view that it is a fit case for grant of bail to the applicant. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
