Order On Board 20/08/2015 Heard.

Learned counsel for the petitioner submits that despite the direction of this Court, representation of the petitioner has not been decided within the time stipulated. On petitioner own showing, the previous incumbent officer was transferred and the new Officer has joined in the month of August.

It goes without showing that the new incumbent is duty bound to comply with the direction issued by this Court as it was not complied with by his predecessor in office. As the petitioner has already submitted the representation in the office, there is no necessity to file a fresh representation.

A copy of this order which is now being passed shall be placed before the respondent No. 2 and he shall decide the petitioner's case within a period of 3 months from the date of submission of certified copy of this order. In case, it is found that representation has not been decided within 3 months as directed, this Court would be constrained to initiate contempt proceedings against the respondent No. 2 namely- Indu Lal Patel the Chief Municipal Officer Nagar Panchayat Geedam.

Accordingly, the petition is disposed off.
