04/09/2015 According to the petitioner, there is no Government Boys School in village Badedumarpali, but, in the name of the said School, the Sarpanch and the fair price shop keeper are showing the supply of food grains under the mid-day meal scheme and thereby grabbing Government funds.

Counsel for the petitioner submits that the petitioner has already made representation to the Collector vide Annexure P/4 but till date the same has not been
decided. He submits that at this stage he may be permitted to withdraw this petition with liberty to file fresh representation, however, direction may be issued to the Collector to decide the same expeditiously.

Counsel for the State, on the other hand, submits that let the petitioner makes a fresh representation to the Collector and the same would be considered and decided in accordance with law, if already not decided.

Accordingly, petitioner is permitted to withdraw this petition with the aforesaid liberty. Needless to state that if the petitioner files any such representation before the Collector, it is expected from the Collector to look into the matter and act in accordance with law.
