Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 15/01/2016 Heard.
1. Vide order dated 30th July, 2015 passed in WPC No.1308/15, a direction was given to the respondent to decide petitioner's representation.
2. In the return filed on affidavit, it has been stated that respondent has considered representation of the petitioner. The power and authority to release amount payable to the petitioner vests with the Managing Director, therefore, vide memo dated 20th July, 2015 followed by memo dated 13.8.2015, 31.10.2015, 23.12.2015 and 26.12.2015 have been sent to the Managing Director of Chhattisgarh Rajya Sahkari Vipnan Sangh Maryadit, Raipur for taking appropriate decision in the matter of payment of commission with a specific reference to order passed by this Court as also filing of the contempt petition.
3. After going through the reply of the respondent, I am satisfied that respondent has done what could be done on his part and within his authority. It is found that number of letters have been written to the Managing Director, but, till date, the decision has not been taken in the matter of the petitioner.
4. In view of the above, rule against the respondent is discharged. The Managing Director of Chhattisgarh State Co-operative Marketing Federation, Raipur is now directed to take appropriate decision on communications which have already been made to him by respondent herein in the matter of petitioner's claim for commission. This shall be done within a period of 90 days from the date of receipt of copy of this order along with copy of earlier order passed by this Court on 30.7.2015 in WPC No.1308/2015.
