1. Heard on IA No.1, application for condonation of delay in filing this application.

2. Considering the duration and the fact that no objection has been raised by the State counsel, IA No.1 is allowed and delay is condoned.

3. The present application has been filed seeking restoration of Second Appeal No. 207 of 2009 which was dismissed on 22.11.2013 for want of prosecution.

4. Learned counsel appearing for the Applicant submits that due to inadvertence on the part of counsel for the Applicant he could not appear before the court, to which learned counsel for the State has no objection.

5. Having considered the reasons specified in the application and found them to be satisfactory and also considering the fact that Second Appeal was already admitted, the application is allowed and Second Appeal No.207 of 2009 is restored to its original number.
