Alleging willful and deliberate non compliance of order dated 03.01.2017 passed by this court in WPS No.1789 of 2016, the present contempt petition has been filed.
2. The counsel for the petitioner today makes a submission that pending the contempt petition, the petitioner has been paid pensionary benefits except for the gratuity amount.
3. Admittedly, the decision which was required to be taken by the respondents pursuant to the above order has already been taken by the respondents and thus, the respondents have substantially complied with the order passed by this court.
4. In view of the fact that respondents have substantially complied with the order of this court, this court does find any reason to proceed
-2further in the matter initiating contempt proceeding against the respondents.
5. Accordingly, the rule is discharged and contempt proceeding is dropped against the respondents. The earlier order for issuance of bailable warrant stands recalled. No order as to costs.
