Hon'ble Justice Shri Gautam Chourdiya Order on Board 02/12/2020 1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 02/09/2020 in connection with offence under Section 366, 395, 397, 376(d), 328 of the IPC registered at Police Station Bhilai Bhatthi, District Durg (C.G.) under Crime No. 40/2020. 2) At the very outset, learned counsel appearing for the applicant, on instructions seeks to withdraw this application with liberty to file a fresh application as and when occasion arises. 3) Accordingly, the application is disposed of as withdrawn with the liberty as stated above.
