Agrawal Order On Board 18/06/2019 (1) Learned counsel appearing for the petitioner would submit that the petitioner has made an application under Section 151 of the CPC before the Executing Court on 18.06.2018 and, therefore, the same may directed to be disposed of expeditiously. (2) I have heard learned counsel appearing for the petitioner and considered his submissions and went through the record with utmost circumspection.

(3) Be that as it may, since the matter is pending consideration before the Executing Court, the said Court is directed to consider and dispose of the said application expeditiously, and if the petitioner files the application for interim relief (if any), that will be considered and decided in accordance with law expeditiously. (4) With the aforesaid direction, the writ petition stands finally disposed of. (5) It is made clear that nothing in this order shall be construed as an expression of an opinion on merits of the case and the Executing Court is to decide the matter on its own merits in accordance with law.
