The petitioner was transferred on 22/08/2019 from Surajpur to Raigarh on his own request by Annexure P-4. It is contended that the transfer was made on the ground that the petitioner has to look after his old parents. Subsequently within a short span of time, again the petitioner has been transferred from Raigarh to Bijapur which is 800 kms away by Annexure P-1 dated 20/08/2020.

Learned counsel submits that on the earlier occasion the petitioner was granted liberty to seek instruction as to whether being probationer he want to contest the petition or not. Learned counsel submits that instruction has been received and the petitioner want to contest this petition. Learned counsel further submits that representation has been made by the petitioner by Annexure P-8 to the respondent/authority. 3.

Perused the document Annexure P-4 which was earlier transfer dated 22/08/2019 and the recent transfer which is made on 20/08/2020 by

Annexure P-1. Considering the time gap in between earlier transfer from Surajpur to Raigarh and recent transfer from Raigarh to Bijapur, the petitioner is given liberty to make a fresh representation to respondent No.2, Under Secretary, Department of Rural Industries (Sericulture), Mantralaya, Mahanadi Bhawan, Nava Raipur, District Raipur within a period of three weeks from today. If such representation is filed, same may be decided within a further period of 60 days. Till then the transfer order Annexure P-1 dated 20/08/2020 in respect of the petitioner shall not be given effect to.
