The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.134/2016 registered in Police Station Balko Nagar, Distt. Korba (C.G.) for offence punishable under sections 186, 323, 332, 353, 294, 506/34 of Indian Penal Code. 2.

As per the prosecution case on 16/05/2016 Sujata P. Das was performing her duty in village Gahniya, at that time applicant along with another co-accused Indal Kumar has assaulted the said forest officer by way of wooden handle of axe and thereby offence is committed. 3.

Learned counsel for the applicant submits that the main allegation of assault is against Indal Kumar and applicant was only along with the other co-accused, therefore the applicant has not committed any offence and he has been falsely implicated. Therefore, learned counsel submits that the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of the victim Sujata P. Das wherein main

allegation is on the other co-accused Indal Kumar and it is stated that the applicant was holding slingshot and also considering the role played by the applicant, charge sheet has been filed and the main allegation is on the other co-accused, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
