The present is a fourth application filed under Section 439 of CrPC seeking for grant of bail to the Applicant who is in jail since 28.1.2018 in connection with Crime No. 112/2017 registered at Police Station Pakhanjoor, District Uttar Bastar Kanker, for the offence punishable under Sections 420, 467, 498, 471 of the Indian Penal Code. 2.
The earlier three bail applications stood rejected vide orders dated 12.7.2018, 7.12.2018 and 16.8.2019 respectively. While rejecting the third bail application, this Court had granted liberty to the Applicant to revive the bail application after six months; hence this application. 3.
During the course of hearing, learned Counsel for Applicant himself has fairly submitted that there are just about 1-2 witnesses left for being examined on behalf of the prosecution. This averment itself would show that the trial is at the fag end.

Given the fact that the trial itself is at the fag end, this Court is not inclined to entertain the present bail application at this juncture, particularly taking into consideration the gravity of the offence and therefore the bail application at this juncture is rejected.

However, considering the fact that the trial is at the fag end, the Trial Court is directed to ensure that the proceedings in the present case be taken up on priority basis since there are only a couple of witnesses left for being examined and the Applicant is in jail since almost three years. 6.
M.Cr.C. accordingly stands rejected.
