---- Respondents 06/08/2015 Shri Pradeep Shrivastava, counsel for the petitioner. Shri Arun Say, Dy.A.G. for the State.
By this application, order dated 27.4.2015 passed in WP (227) No.309/15 is sought to be reviewed on various grounds, one of them being that as an advocate I had appeared for respondent No.5 - Bhilai Nagrik Sahkari Samiti though in some other matter i.e. WP No.3237/1998.
Vide order dated 27.4.2015 the writ petition filed by the applicant/petitioner was dismissed at the motion stage itself though on merit. In this review application several grounds have been raised and one of the important point is that I had appeared as counsel for respondent No.5 - Bhilai Nagrik Sahkari Samiti though in some other matter i.e. WP No.3237/1998. It is submitted by counsel for the petitioner that the issue involved in WP No.3237/1998 is having some bearing in present case as well.
This fact was not brought to the notice of this Court at
the time of hearing of the writ petition and the same is being pointed out for the first time by way of this review.
Be that as it may, since the aforesaid fact has been brought to my knowledge by way of review application though belatedly, it would be fair on my part to recall the order dated 27.4.2015 and restore the writ petition to its original number without touching the other grounds raised therein. Order accordingly.
Order dated 27.4.2015 is recalled and the writ petition is restored to its original number.
