The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.25/2016 registered in Police Station Janakpur, District-Koriya (C.G.) for offence punishable under sections 363, 366, 376, 370, 370 (A)/34 of Indian Penal Code and 4, 5 (L), 6, 9 (L) & 10 of the Protection of Children from Sexual Offences Act, 2012. 2.

As per the prosecution case a report was made by father of the victim on 30/01/2016 that on 25/01/2016 the victim instead of going to her hostel went away with other co-accused namely Rajkumar who allured her and took her away to Meerut and Delhi and during such journey present applicant helped both of them to travel to Meerut and Delhi and also helped them to find out suitable home and the girl was recovered from the possession of Rajkumar.

Learned counsel for the applicant submits that main allegation of allurement and taking away the girl is on Rajkumar and allegation of providing assistance to them is on the applicant Therefore, learned

counsel submits that the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary and the documents and also statement of the victim. Considering the degree of allegation against this applicant that he assisted Rajkumar and the victim to travel to Meerut and Delhi, taking into such role played by this applicant, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
