Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 15/06/2016

1. Heard on prayer for correction of Crime Number in the bail order dated 2.6.2016 passed in MCRC No.2537 of 2016.

2. On the last date of hearing, State counsel was directed to produce the case diary. Diary has been produced. In the concerned diary, it has been found that the number of crime has been recorded as 37/2016.

3. The mistake seems to have occurred because while rejecting petitioner's bail application, the Court below also recorded the crime number as 36/2016, which was recorded in the bail application and the order passed by this Court on 2 nd June, 2016.

4. In view of the above consideration, it is directed that the order dated 2.6.2016

-2passed in MCRC No.2537 of 2016 shall be considered as an order for grant of bail to the petitioner/applicant in connection with Crime No. 37/2016, registered in Police Station -Lalpur, District, Mungeli for the offence under Sections 34 (1) (a), 34 (2) and 59-A of the C.G. Excise Act.

5. The petition is accordingly allowed.
