NAFR HIGH COURT OF CHHATTISGARH, BILASPUR CONT No. 302 of 2015 Laxmi Narayan Mahto S/o Shri J.R. Mahto Aged About 54 years R/o Sector-1, Street No. 3, Professor Colony, Raipur, Chhattisgarh ---- Petitioner

Versus

1. Dr. Y. P. Rai Chief Post Master General , Chhattisgarh Circle, Raipur, Chhattisgarh

2. Ashish Singh Thakur Chief Superintendent, Post Office, Raipur Division, Raipur, Chhattisgarh ---- Respondents For Petitioner - Shri Chandresh Shrivastava, Advocate For Respondents - Shri N.K. Vyas, Asst. S.G.

Order On Board 10/07/2015 Heard.

1.

This petition has been filed by the petitioner alleging willful disobedience of order dated 15.5.2015 on the submission that when the petitioner joined after availing medical leave, he is not being allowed to join and the main operative reason for such denial is the order of cancellation of caste certificate which has been impugned in the writ petition and there is interim direction not to take any action against the petitioner pursuant to cancellation of his caste certificate. 2.

It prima facie appears that the petitioner was on medical leave and thereafter he has submitted his joining along with fitness certificate. Till date, no orders have been passed by the authority. Therefore, at this stage, I am not inclined to issue notice. The effect of interim order is that the petitioner cannot be denied joining on the ground of cancellation of his caste certificate. The respondent No.1 shall either allow the

petitioner to join or if for reason other than cancellation of caste certificate, he cannot be allowed to join, a specific order in writing shall be passed within a period of one week from the date of production of the copy of this order, which is now being passed. Thereafter, if the eventuality so arises, the petitioner would be at liberty to revive the contempt petition.

3.

With the aforesaid observations, the contempt petition is disposed off. Sd/- Manindra Mohan Shrivastava J U D G E Rekha
