The challenge in the present Writ Petition is to the order of appointment issued in favour of the respondent No.6 by way of grant of compassionate appointment.

The counsel for the petitioner submits that, the petitioner also had moved an application for grant of compassionate appointment and he was also considered for the said appointment and in the scrutiny, he was also

found eligible and in all there were three candidates who were found eligible of which the petitioner had secured the maximum marks and the respondent No.6 had secured 2nd position in the order of ranking, yet the respondents have without any reason disclosed to the petitioner issued an order of appointment in favour of the respondent No.6. He further submits that, the petitioner has also made an objection to the Collector, Balrampur in this regard, though he has not enclosed a copy of the same along with the present Writ Petition.

Therefore, the petitioner is at liberty to file a fresh representation/appeal to the Collector, Balrampur against the order of appointment issued to the respondent No.6 who in turn shall decide the same objectively considering all the contentions and also after scrutinizing the process initiated by the respondents so far as the petitioner and the respondent No.6 is concerned. 4.

On the petitioner filing a representation within a period of 15 days from today before the Collector, Balrampur, the same shall be decided within a further period of 60 days from the date of receipt of certified copy of this order.
