This is an application under Section 438 of CrPC for grant of anticipatory bail to the applicant as he apprehends his arrest in connection with Crime No.146 of 2020 registered at Police Station Jaijaipur, District Janjgir-Champa, Chhattisgarh for commission of offenses punishable under Sections 458, 354, 506 of IPC and Section 8 of Protection of Children from Sexual Offences Act, 2012 (POCSO). 2.

Learned counsel for the applicant seeks permission of this Court for withdrawal of bail application. He further prays for a direction to the Court below concerned to consider and decide the application for grant of regular bail if filed by the applicant upon his surrender, on the same day.

Learned State counsel submits that he has no objection to the submissions made by learned counsel for the applicant.

In view of above, MCRCA-1012 of 2021 is dismissed as withdrawn. 5.

Learned Court below concerned may consider and decide the application for grant of regular bail if filed by the applicant after his surrender, if possible on the same day, in accordance with law.
