Short grievance as ventilated through this petition is that though the petitioner had moved application for grant of temporary permit, the same has remained pending for more than one month.

Even though, there is no statutory period prescribed under the law to decide such application by the very nature of the application, it is proper that such application is decided as early as possible.

Therefore, without commenting upon merits of the case, the competent authority shall decide the application as early as possible preferably within a period of 45 days from the date of receipt of copy of this order.

This order shall not come in the way of the authority in deciding other applications for temporary permit, in respect of the same route, filed by any other operator as per the provisions of the Motor Vehicle Act and Rules made thereunder. 5.
Accordingly, the petition is disposed off.
