In view of Annexure R/1 annexed to the counter affidavit by the Respondents, enclosing the deliberations of the Departmental Promotion Committee dated 10.1.2013 and the correctness of which cannot be examined on merits in contempt proceedings, we are not inclined to proceed any further in the contempt jurisdiction.

If the Petitioner is aggrieved by the order dated 10.1.2013, he may

assail the same in accordance with law, if so advised. 4.

The application stands dismissed.
