The grievance of the petitioner is that the complaint case of the petitioner has remained pending despite specific direction of this Court vide order dated 05/10/12 in CrMP No.765/12, the proceedings have remained pending without any material progress. The complainant is not pursuing his complaint and seeking frequent adjournment.

Without commenting upon the merits of the case, in view of order dated 05/10/12, the Trial Court should have taken expeditious steps to decide the case of the petitioner one way or the other. The petition, at this stage, is disposed off with a direction to the Trial Court to decide the criminal case as early as possible without giving unnecessary adjournments.

If the trail is not concluded within a period of four months, the petitioner would be at liberty to revive this petition.
