Order On Board 07/08/2015 Heard.
(1) It is alleged that by impugned order dated 27.07.2015, bringing the petitioner's deputation to an end, the respondent has acted in willful disobedience of order dated 08.12.2011. (2) The petitioner grievance in the writ petition was that despite transfer order, he is not being allowed to join.
(3) In view of order dated 08.12.2011 passed in WPS No. 2782/2011, the petitioner was admittedly allowed to join and he has been working for the last 4 years. (4) Now as a subsequent event, a proposal was made for repatriation of the petitioner on the ground that his services are not satisfactory and then an order has been passed on 27.07.2015 terminating his deputation.
(5) The order has been passed on reasons which were not existing earlier before. Petitioner can not claim to continue for indefinite period. Thus, the contempt petition is misconceived and therefore, it is dismissed. However, the petitioner is at liberty to challenge the order of 27.07.2015 on such grounds as may be available to him under the relevant provisions of law. Sd/- Manindra Mohan Shrivastava Judge Amita
