The present Cr.M.P has been preferred seeking for quashment of the order dated 25.4.2014 passed in Complaint Case No.84/2013 by the JMFC, Raipur.

During the course of arguments, learned Counsel for the Petitioner submits that Complaint Case No.84/2013 has already culminated and has resulted in the conviction of the Petitioner vide judgment dated 26.8.2015 and against the said judgment of conviction, the Petitioner has already preferred an Appeal on 21.9.2015 which is pending consideration before the Sessions Court at Raipur.

Needless to mention that the Petitioner has also taken all these grounds that he has raised in the said appeal which is pending consideration before the Appellate Court.

In view of the fact that the Appeal has already been filed, in the opinion of this Court, the Petition is totally misconceived and is not maintainable. 5.

For the reasons as mentioned above, the Petition being devoid of merits, the same is accordingly rejected.
