The petitioner has filed this petition on the apprehension that on the basis of special report of audit, the respondents may either initiate disciplinary action, recovery or direct lodging of criminal case.

At this stage, all that has happened is that a report has been submitted, which in terms, does not say that offence should be registered or disciplinary enquiry should be initiated against the petitioner or any king of proceedings should be initiated against him. Therefore, to my mind, the petition is pre-mature. In case, any kind of proceedings are initiated against the petitioner, he would be at liberty to take recourse to remedy as may be available to him under the law.
