The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 39/2016 registered in Police Station Ramanujnagar, District Surajpur (C.G.) for offence punishable under Section 302, 201 of Indian Penal Code.

As per the prosecution case a dead body was found on 24/02/2016 which was reported by one Sahadur Singh and on investigation it was revealed that Sushma who was in love affair with the applicant was murdered and after recovery of the dead body, offence has been registered.

Learned counsel for the applicant submits that still identity of the dead body which was in decomposed condition has not been established, therefore death of Sushma that is in question. He further submits that only on the suspicion Sushma was in love relation with the applicant, applicant
has been inculpated, no evidence is available against the applicant therefore the applicant may be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail. 5.
Perused the case diary. Perusal of the case diary would show that at the instance of the applicant ladies purse, sleeper was recovered which belonged to the deceased. Considering the circumstantial evidence as available in this case, this court is not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed. Certified copy as per rules.
