Hon'ble Shri Gautam Chourdiya, Order on Board 27/11/2020 [

1. The applicant has filed this application under Section 439 of the Code of Criminal Procedure for grant of regular bail as he is in custody in connection with Crime No.347/2020 registered at Police Station - Jamul, District - Durg (CG) for the offence punishable under Sections 380, 34 IPC.

2. As per prosecution case, the applicant alongwith co-accused have committed theft of copper-wire from factory of complainant and same has been recovered from the applicant which costs Rs.40,000/-.

3. Counsel for the applicant submits that the applicant has been falsely implicated in the crime in question and the applicant is in

jail since 03.08.2020 and the trial is likely to take some time for its final disposal, therefore, he be released on bail.

4. On the other hand counsel for the State opposes the bail application.

5. Having heard counsel for the parties, considering the facts and circumstances of the case, in particular the nature of allegations against the applicant, his detention period and the fact that conclusion of the trial is likely to take some time, I am inclined to release him on regular bail. Accordingly, his application filed under Section 439 of the Code of Criminal Procedure is allowed.

6. It is directed that in the event of the applicant' furnishing a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the concerned Court, he shall be released on bail. He is also directed to appear before the trial Court on each and every date given to him by the said Court, till disposal of the trial.

7. It is made clear that the applicant shall not involve himself in any offence of similar nature in future or else this order granting bail to the applicant shall automatically stands cancelled without further reference to the Bench.
