For Non-Applicant : Shri Sudeep Agrawal, Deputy AG. Proceeding Through Video Conferencing Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 15/10/2020 :

1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.252/2020 registered in Police Station Torwa, District Bilaspur for offence under Section 420 of the IPC.

2. The applicant has allegedly obtained Rs.3 lakhs from the complainant for arranging employment but failed to provide employment or return the amount.

3. It is argued that the applicant's wife lodged a complaint with the Superintendent of Police on 7.8.2020 vide Annexure-A/3, against the

present complainant's family alleging refusal to make repayment of the loan amount. Therefore, the present FIR has been lodged on the next day i.e. 8.8.2020, as a counterblast to the complaint (Annexure-A/3).

4. Considering all the relevant aspects of the matter and for the fact that the applicant is in jail since 8.8.2020, and that the offence is triable by the JMFC, this Court is inclined to release the applicant on bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
