1. The applicant has preferred first bail application u/s 439 of Cr.P.C. for grant of bail as he is arrested on 27.04.2020 in connection with Crime No. 95/2020 registered at Police Station Manendragarh District Koriya for offence punishable under sections 294, 506, 323, 302 r/w 34 of IPC.
2. As per the prosecution case on 23.03.2020 the applicant namely Devlal Pando assaulted the deceased Rajman Bai on her head by club whereas Ramkumar dragged her outside the house, subsequently, she has succumbed to the injury.
3. Learned counsel for the applicants would submit that the FIR was logged on 14.03.2020, wherein allegation of assault has been attributed to Devlal Pando. Subsequently, during the investigation
the applicants have been falsely implicated, therefore, the applicants may be enlarged on bail.
4. Learned State counsel opposes the prayer for grant of bail and went through the statement of the eye witness Shanti Bai and Preeti aged about 9 years.
5. Perused the statements of the eye witness Shanti Bai and Preeti. Considering their statement wherein direct allegations have been attributed, therefore, I am not inclined to grant bail.
