This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.268/2015 registered at Police Station- Old Bhilai, District Durg (C.G.) for the offence punishable under Section 307, 452/34 of Indian Penal Code. 2.

Case of the prosecution, in brief, is that the applicant alongwith his wife assaulted her sister-in-law Smt. Santoshi Thakur by Knife and thereby, the offence is committed.

Learned counsel for the applicant would submit that the incident happened in between the family members and there was no intention to kill her sister-in-law and on a domestic quarrel the incident had happened. He further submits that the similarly placed accused Smt. Malti Singh has been enlarged on bail by the coordinate Bench of this Court on 18.02.2016 in M.Cr.C. No.643 of

2016, therefore, the present applicant may also be enlarged on bail, as all the injuries are simple in nature.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the statement of the victim Smt. Santoshi Thakur wherein the main allegation of assault by Knife is on the present applicant and as many as six injuries were caused by Knife over the abdomen. Considering such statement and the background of this case, I am not inclined to release the applicant on bail. 6.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is rejected.
