The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.6/2016 (as per challan) registered in Police Station Lalbagh, Rajnandgaon for offence punishable under sections 394 of Indian Penal Code.

As per the prosecution case on 4/01/2016 a report was made by one Kamlesh son-in-law of the victim that on 3/01/2016 while his father-inlaw was returning from village Pendri, at that time three persons came in motorcycle intercepted his way and thereafter assaulted him by way of a knife and looted Rs.2000/- and mobile. Subsequently, on investigation the applicant was arrested.

Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and only Rs.500/- has been seized from him and no other articles were seized from him, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perusal of the case diary and the documents would show that

applicant has been identified and also considering the way the offence has been committed that the victim was assaulted by way of a knife and loot was committed, this court is not inclined to release the applicant on bail. 6.

Accordingly, the bail application is dismissed. Certified copy as per rules.
