Various affidavits has been filed in these appeals by the learned counsel for the appellants to clarify the circumstances under which more than one appeals came to be filed by appellants - Gaurishankar and Krishna Kumar.

Having gone through the records of the three appeal, we find that more than one appeal came to be filed on behalf of Gaurishankar and Krishna Kumar because the relatives of the these appellant have contacted different offices and appeal came to be filed. Be that as it may, considering that Gaurishankar and Krishna Kumar had already filed appeals.

Considering that appeal on behalf of Gaurishankar and Krishna Kumar was already filed along with other co-accused convicts in CRA No. 541 of 2021, the appeals filed at later the point of time namely CRA No. 840 of 2021 and CRA No. 841 of 2021 could not survive. These two appeals are therefore, disposed off.

Mr. Prakash Tiwari is the counsel who had filed subsequent appeal, having been authorized by the father of the accused Gaurishankar and Krishna Kumar is permitted to argue for these appellants in CRA No.541/2021.

CRA No. 541 of 2021 is admitted for hearing.

Learned State counsel takes notice and may file objection/reply on application for suspension of sentence and grant of bail within three weeks. The Registry to prepare paper book as per rules, upon receipt of records.
