1. The present petition is against the order dated 07.10.2017 passed by JMFC, Raipur, learned counsel for the petitioners submits that in respect of the same complaint or the allegation of 20.03.2016 earlier the complaint was filed, which was dismissed after investigation. He submits that suppressing the said fact another complaint of the same incident has been lodged, wherein the other Court of JMFC has issued summons.

2. At this stage, this Court is not inclined to go into the merits of this case as the petitioner can very well agitate his grievance before the revisional Court

of competent jurisdiction. Exercising power under Section 226 of the Constitution of India at this stage would be premature. Accordingly, the petition is disposed of with a liberty to the petition to avail the appropriate remedy before Sessions Court.

3. Registry is directed to return the certified copy of the impugned order to the petitioner after retaining photocopy of the same. Sd/- Goutam Bhaduri Judge Ashu
