Learned counsel for respondents No.1 to 4 would submit that the petitioner's services were terminated by the CIDC on 3-9-2004, therefore, the petitioner's remedy is to file application under Section 31 (3) of Chhattisgarh Industrial Relations Act, 1960 before the Labour Court for adjudication.

Learned counsel for the petitioner would submit that the petitioner's appeal has been dismissed by the respondent authorities without giving opportunity of hearing. 3.

Be that as it may, the petitioner is at liberty to make application under Section 31 (3) of the Chhattisgarh Industrial Relations Act, 1960 before the Labour Court and if such application is made within four weeks from today, the Labour Court shall consider and decide the same within six months from the date of filing of the application, in accordance with law and on its own merits. 4.

With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
