1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 209/2015 registered at P.S. Pendra, District Bilaspur (C.G) for the offence punishable under Section 363, 370, 371 of IPC.
2. As per the prosecution case, on 03.10.2015 a report was lodged by complainant Lal Singh that his son along-with three persons have been taken by Uday Bhan and the boys were working at Karnataka. Thereafter, the police during investigation recovered the boys from a Bore Well Machine Works which was run by co-accused K. Anand @ Anand at Karnataka.
3. Learned counsel for the applicant submits that the other coaccused K. Anand has been enlarged on regular bail in M.Cr.C.No.7591/2015 on 13.01.2016 and thereafter he was absconding.
4. Per contra, learned State Counsel opposes the bail.
5. Perused the statements of Arun Singh, Arjun Singh and others wherein the main allegations have been attributed to this applicant and the case of the applicant is different from that of co-accused who has been enlarged on bail.
6. Taking into statements wherein the primary allegations are attributed to the applicant, I am not inclined to release the applicant on bail. Accordingly, it is dismissed. Sd/- GOUTAM BHADURI JUDGE R a o
