This is third bail application.

First bail application was rejected on merit vide order dated 19.03.2020. The second bail application was rejected on 22.06.2020. 3.

Learned counsel for the applicant submits that third bail application is being filed mainly to highlight contents of statement under Section 164 of Cr.P.C. as also delay in trial.

As far as Section 164 Cr.P.C. statement is concerned, perusal of order dated 19.03.2020 shows that while rejecting bail application, submission and statement under Section 164 Cr.P.C. were also taken into consideration. As far as delay part is concerned, taking into consideration the nature and gravity of allegation, at this stage, I am not inclined to grant bail only on the ground of delay. However, if the trial does not commence within three months, the applicant would be at liberty to revive application only on the ground of delay in trial. The bail application is therefore rejected.
