The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.172/2013 registered in Police Station Kotwali, Jagdalpur, District Bastar, (C.G.) for offence punishable under sections 406, 408, 468, 471, 465, 420 & 120 (B) of Indian Penal Code.

As per the prosecution case, the applicant alongwith one Philip P. Raju who was authorized to keep money in the ATM on the different dates from 2010 committed misappropriation of the amount and about Rs.21,00,700/- was misappropriated.

Learned counsel for the applicant submits that applicant has been falsely implicated in the case, actual allegations have been attributed to Philip P. Raju and the officers of the bank and if the fact came to the notice of the officers of the bank immediately but in order to pass on the allegation the applicant has been implicated who is contract employee. Therefore, learned counsel submits that the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Perused the case diary and the statement of the witness Goutam Garg who is branch head of CMS. Considering the statement and the way money has been siphoned from the ATM, this court is not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed. Certified copy as per rules.
