This is the first bail application filed under Section 439 of the Code of Criminal Procedure, for grant of bail to the applicant who has been arrested on 20.3.2018 in connection with Crime No.44/2018, registered at Police Station Bhilai Bhatti, Distt. Durg (CG) for the offence punishable under Sections 376, 120B, 34 of the Indian Penal Code.

Allegation against the present applicant is that on the date of incident, he has taken key of the house of his friend, took the prosecutrix there and committed rape with her without her will and consent.

Learned counsel for the applicant submits that the applicant is innocent, the trial will take some time for its conclusion, therefore, he may be released on bail.

On the other hand, learned counsel for the State opposes the bail application.

I have heard learned counsel for the parties and perused the case diary.

Looking to the direct involvement of the applicant in the commission of offence and also considering the gravity of offence, I am not inclined to release the applicant on bail. 7.
Accordingly, application filed under Section 439 of the CrPC is hereby rejected.
